Agreement to Terms
Welcome to Access Assured! These Terms of Service ("Terms") constitute a legally binding agreement between you and Access Assured LLC ("Company," "we," "us," or "our"), a limited liability company organized under the laws of Ohio, regarding your use of our email account recovery services.
By accessing our website at www.accessassured.co, completing our assessment form, or purchasing our services, you agree to be bound by these Terms. If you don't agree with any part of these Terms, you may not use our services.
Services Description
Access Assured provides email account recovery services to help individuals regain access to locked or inaccessible email accounts. Our services include:
- Free Assessment: A questionnaire that analyzes your situation and provides a custom recovery checklist
- Starter Recovery ($49): Guided support including recovery plans, documentation templates, email/call scripts, and priority support
- Concierge Recovery ($199): Full-service recovery where we handle provider communications, document preparation, and submission on your behalf
Important Disclaimers
No Provider Affiliation
We are not affiliated with, endorsed by, or officially connected to Google, Microsoft, Yahoo, Apple, or any other email service provider. We are an independent service that helps you navigate each provider's recovery process.
No Guarantee of Account Recovery
While we have significant experience with account recovery processes, we cannot guarantee that you'll regain access to your account. The final decision on account recovery rests entirely with the email provider. We guarantee we'll make documented progress on your case (see our Refund Policy), but we can't control provider decisions.
Account Ownership and Authorization
You represent and warrant that:
- You are the rightful owner of the account you're trying to recover, OR
- You have proper legal authorization to access the account (e.g., as a family member, executor, power of attorney, or guardian)
- All information you provide to us is truthful and accurate
We reserve the right to refuse service or terminate services if we have reason to believe a recovery request is fraudulent or unauthorized.
Eligibility and User Responsibilities
Eligibility
You must be at least 18 years old to use our services. If you're helping a family member, you confirm you have their permission or legal authority to act on their behalf.
Your Responsibilities
When using our services, you agree to:
- Provide Accurate Information: Give us truthful, complete information about your account situation
- Respond Promptly: Reply to our requests for additional information within reasonable timeframes
- Maintain Confidentiality: Keep any credentials or sensitive information we share with you secure
- Follow Instructions: For Starter Recovery, follow our guidance carefully to maximize success
- Use Services Legally: Only use our services for legitimate account recovery purposes
Prohibited Uses
You may NOT use our services to:
- Gain unauthorized access to accounts you don't own or have permission to access
- Harass, stalk, or harm others
- Engage in any illegal activity
- Impersonate another person without authorization
- Interfere with provider systems or violate their terms of service
Payment Terms
Pricing
Our current pricing is:
- Free Assessment: $0
- Starter Recovery: $49 (one-time payment)
- Concierge Recovery: $199 (one-time payment)
Beta Pricing Lock-In: As an early customer during our beta period, your pricing is locked in. If we raise prices in the future, you'll continue to receive services at the rate you originally paid (for subscription services, if applicable).
Payment Processing
Payments are processed securely through Stripe. By providing payment information, you authorize us to charge the applicable fees. You represent that you have the legal right to use any payment method you provide.
One-Time vs. Subscription Payments
Unless otherwise stated, our services are one-time purchases. If we offer subscription services in the future:
- You'll be charged automatically on your renewal date
- You can cancel anytime before your next renewal date
- Refunds for subscription services will follow our standard refund policy
Cancellation
You may cancel services at any time by emailing support@accessassured.co. Refunds for cancellations are governed by our Refund Policy.
Service Delivery and Timelines
Response Times
- Concierge Recovery: We respond to inquiries within 4 business hours
- Starter Recovery: We respond within 24 business hours
- Free Assessment: Instant results upon form completion
Business Hours
Our support team operates Monday-Friday, 9am-6pm EST, and Saturday 10am-4pm EST. We're closed Sundays and major U.S. holidays.
Recovery Timelines
Most account recoveries are completed within 24-48 hours once we have all necessary information and submit requests to providers. However, timelines vary based on:
- Provider response times (outside our control)
- Complexity of the case
- Availability of recovery information
- Need for additional verification documents
Some cases may take 3-5 business days or longer, especially if providers request additional documentation or verification.
Intellectual Property
Our Content
All content on our website, including text, graphics, logos, images, and software, is the property of Access Assured LLC and is protected by U.S. and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without written permission.
Templates and Materials
Recovery checklists, templates, and scripts we provide as part of Starter or Concierge Recovery are for your personal use only. You may not resell, redistribute, or use them for commercial purposes.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
Access Assured LLC, its officers, directors, employees, and agents SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data or access to accounts
- Lost business or lost opportunities
- Emotional distress
- Any damages resulting from your use or inability to use our services
Our total liability to you for any claims arising from our services is limited to the amount you paid us for the specific service in question. For free services, our liability is limited to $0.
Provider Decisions
We are not responsible for decisions made by email providers (Google, Microsoft, Yahoo, Apple, etc.) regarding account recovery. If a provider denies your recovery request despite our best efforts, we are not liable for that decision or its consequences.
No Liability for Data Loss
We strongly recommend backing up any important data from accounts before initiating recovery. We are not responsible for any data loss, email deletion, or other consequences that may occur during the recovery process.
Indemnification
You agree to indemnify, defend, and hold harmless Access Assured LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your violation of these Terms
- Your violation of any law or third-party rights
- Your use of our services
- Any false or misleading information you provide
- Unauthorized use of accounts
Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using our services, you consent to our data practices as described in the Privacy Policy, including:
- Collection of personal and account-related information
- Use of information to provide recovery services
- Sharing information with email providers as necessary for recovery
- Retention of information as described in our data retention policy
Modifications to Services and Terms
Changes to Services
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice. We may also change pricing for future customers, but your pricing is locked in as described above.
Changes to Terms
We may update these Terms periodically. When we make material changes, we'll notify you by:
- Updating the "Last updated" date at the top
- Sending an email to your registered address
- Posting a notice on our website
Your continued use of our services after changes take effect constitutes acceptance of the new Terms. If you don't agree with changes, you must stop using our services.
Termination
Termination by You
You may stop using our services at any time by emailing support@accessassured.co. Refunds, if applicable, will be processed according to our Refund Policy.
Termination by Us
We reserve the right to suspend or terminate your access to our services, with or without notice, if:
- You violate these Terms
- We suspect fraudulent or unauthorized activity
- You fail to pay applicable fees
- We're required to do so by law
- We cease offering services
Effect of Termination
Upon termination:
- Your right to use our services ends immediately
- We'll complete any in-progress recovery work to a reasonable stopping point
- We'll delete or anonymize your personal data according to our Privacy Policy
- Sections of these Terms that should survive termination (like limitation of liability and dispute resolution) will continue to apply
Dispute Resolution
Informal Resolution
If you have a dispute with us, please contact support@accessassured.co first. We're committed to resolving issues amicably and will work in good faith to address your concerns.
Governing Law
These Terms are governed by the laws of the State of Ohio, United States, without regard to its conflict of law provisions.
Arbitration (Optional During Beta)
During our beta period, we're not requiring binding arbitration. If disputes arise that can't be resolved informally, either party may pursue resolution in small claims court or state/federal court in Ohio.
In the future, we may update these Terms to include binding arbitration for dispute resolution. Existing customers will be notified of such changes.
Class Action Waiver
To the extent permitted by law, any disputes must be brought on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Miscellaneous
Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Access Assured regarding our services and supersede all prior agreements or understandings.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by us.
Assignment
You may not assign or transfer these Terms or your rights under them without our written consent. We may assign these Terms without restriction.
Force Majeure
We're not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or internet outages.
